These Terms & Conditions explain the basis on which eMart Agency provides its website and services.
The service provider is eMart Agency, operated by Abdul Rehman.
01 Scope and Acceptance
These terms apply to service engagements where they are incorporated into an accepted proposal, contract or order.
Each project's written agreement will define its scope, fees, deliverables and other specific requirements. If a project agreement conflicts with these general terms, the project agreement takes priority, subject to applicable law.
02 Our Services
Our services include:
- E-commerce Marketplaces
- Website Design & Development
- Social Media Marketing
- Graphic Design & Creative Services
- Digital Marketing
- Technical SEO & Performance Optimization
Only services expressly included in your accepted proposal or agreement form part of your project.
03 Proposals and Project Scope
Before work begins, we will agree on the required services, deliverables, responsibilities, pricing and estimated schedule.
Additional requests, new features, extra revisions or changes to the original scope may require a separate quotation and revised timeline. Additional charges must be agreed before the extra work proceeds.
04 Client Responsibilities
You are responsible for providing accurate information, necessary materials, authorized account access and timely feedback.
You must have permission to use any content, customer information, images, trademarks or other materials you provide.
You remain responsible for your products, business claims, fulfilment obligations and compliance with applicable laws and platform requirements.
05 Fees and Payments
Fees, currency, payment schedules and any deposits will be stated in the accepted proposal or agreement.
Unless expressly included, advertising spend, subscriptions, hosting, domains, premium themes, paid applications, stock assets and marketplace charges are separate from our service fees.
We will obtain approval before committing you to additional costs. If an agreed payment becomes overdue, we may pause affected work after notifying you and allowing a reasonable opportunity to resolve the matter.
06 Timelines and Approvals
Project schedules depend on the agreed scope, timely access to required information and client approvals.
We will communicate material delays and discuss an updated schedule where needed. Third-party reviews, platform approvals and client-requested changes may affect delivery dates.
07 Revisions and Delivery
The number and type of included revisions will be defined in your project agreement. Feedback should be clear and consolidated where practical.
Final files, access details and other deliverables will be supplied in the agreed formats. Editable source files, training, maintenance and ongoing support are included only where specified.
08 Account Access and Advertising
You authorize us to access and manage only the accounts and activities agreed for your project.
Advertising budgets, account changes and publishing permissions will follow the agreed approval process. You retain ownership of your business accounts and can revoke access, although doing so may prevent us from completing the work.
09 Results and Third-Party Platforms
We aim to improve the areas covered by our services, but we do not guarantee specific sales, revenue, rankings, leads, advertising returns or platform approvals.
Results depend on factors such as competition, product quality, pricing, budgets, customer demand and platform changes.
Marketplaces, search engines, advertising networks and website platforms operate independently. We cannot guarantee their availability or control their decisions.
10 Ownership and Usage Rights
You retain ownership of materials you provide.
Ownership or usage rights for custom deliverables will be defined in the project agreement and transferred or granted after the relevant agreed payments are completed.
Pre-existing tools, reusable components and third-party assets remain subject to their existing ownership and licence terms. We will identify material licensing restrictions relevant to your deliverables.
11 Confidentiality and Portfolio Use
Both parties will protect confidential information received during the project and use it only for the agreed work, except where disclosure is legally required.
We will obtain your permission before using non-public project details, your business name, logo or results in our portfolio or marketing materials.
Personal information is handled as described in our Privacy Policy and any applicable data processing agreement.
12 Cancellation and Refunds
Cancellation rights, notice periods and refund arrangements will be specified in the project agreement.
If a project ends early, the parties will review completed work, outstanding deliverables and any approved costs already incurred. Any refund or remaining payment will be determined under that agreement and applicable law.
Nothing in these terms removes mandatory consumer rights or statutory cancellation and refund rights.
13 Suspension or Termination
Either party may terminate an engagement under the conditions in its project agreement.
We may suspend work involving unlawful activity, unauthorized access or a material breach of the agreement. Where appropriate, we will explain the issue and provide an opportunity to resolve it.
On termination, we will coordinate the handover of deliverables, account access and client information in accordance with the agreement and applicable obligations.
14 Website Use
You must not use our website to submit unlawful material, distribute malicious software, attempt unauthorized access, impersonate another person or interfere with its operation.
Website content belongs to eMart Agency or its licensors unless otherwise stated. Reuse requires permission or another lawful basis.
15 Responsibility and Liability
Each party remains responsible for its own obligations under the agreement and applicable law.
Any agreed limits of liability must be stated in the project contract and apply only where legally permitted. Nothing in these terms excludes liability that cannot lawfully be excluded, including liability for fraud.
16 Disputes and Governing Law
Please contact us first so we can try to resolve any concern through discussion.
Governing law and dispute forum: [Insert the agreed jurisdiction and dispute process following legal review.]
Any applicable mandatory consumer protections remain unaffected.
17 Changes to These Terms
Updated terms will be published with a revised effective date. Changes will not retrospectively alter an existing project agreement without the parties' agreement, except where required by law.
